▶︎パスポートの写真には要注意！
BANK OF GEORGIAもTBCも日本からリモートで口座開設
する場合はパスポートの写真には気を付けましょう。
つまり、人相の悪い写真を使用していると銀行から
「犯罪履歴証明書」の提出を求められます。
最悪は口座開設を断られることもあります。
これは実際に起きた嘘みたいな話です。
▶︎犯罪経歴証明書について
犯罪経歴証明書は、外国の公的機関から要求された場合に発給するのものです。
個人や企業からの要求では取得出来ません。
つまり、公的機関ではない銀行の要求では取得出来ません。
▶︎そもそも、そんなものは不要
私たちは以下の文書を両銀行に提出。
すると、銀行も理解してくれました。
そもそも、銀行員が日本人が知らない細かい法律を理解
しているわけがありませんからね。
・結論:
日本の旅券法第十三条の英訳を掲載。
日本国のパスポートを所持する者に犯罪履歴証明を求めるのは
以下の法的根拠から無意味。
日本国のパスポートを保有していることが潔白であることの証明になる。
・Conclusion:
Contains an English translation of Article 13 of Japan’s Passport Act.
Those who hold a Japanese passport must have no criminal record.
Possessing a Japanese passport is proof of innocence.
・旅券法 第13条(一般旅券の発給等の制限):
外務大臣又は領事官は、一般旅券の発給又は渡航先の追加を受けようとする者が次の各号のいず
れかに該当する場合には、一般旅券の発給又は渡航先の追加をしないことができる。
・Article13 of the Passport Act
(Restrictions on issuance of regular passports, etc.):
The Minister of Foreign Affairs or a consular officer may prohibit the issuance of a
regular passport or the addition of a travel destination if the person who wishes to
receive the issuance of a regular passport or the addition of a travel destination fa
ls under any of the folowing.
1: 渡航先に施行されている法規によりその国に入ることを認められない者
Persons who have violated the laws of their destination and are prohibited
from entering the country
2: 死刑、無期、長期二年以上の刑に当たる罪につき訴追されている者
又はこれらの罪を犯した疑いにより逮捕状、勾引状、勾留状若しくは鑑定留置状が発せられてい
る旨が関係機関から外務大臣に通報されている者
Persons sentenced to death, life imprisonment, or long-term imprisonment of
two years or more or a person for whom an arrest warrant, subduction warrant,
detention warrant, or detention warrant for appraisal has been issued on
suspicion of committing any of these crimes, or a person who has been notified
of these to the Minister of Foreign Affairs.
3: 禁錮以上の刑に処せられ、その執行を終わるまで又は執行を受けることがなくなるまでの者
Sentenced to a sentence of imprisonment or worse,
until the execution of the sentence is completed.
or until the person is no longer subject to execution.
4: 刑に処せられた者

5: 旅券若しくは渡航書を偽造し、又は旅券若しくは渡航書として偽造された文書を行使し、若し
くはその未遂罪を犯し、刑法(明治四十年法律第四十五号)、第百五十五条第一項又は第百五十八
条の規定により刑に処せられた者

passport or travel document, or have been sentenced to prison for attempted
crime
6: 国の援助等を必要とする帰国者に関する領事官の職務等に関する法律(昭和二十八年法律第二百
三十六号)、第一条に規定する帰国者で、同法第二条第一項の措置の対象となったもの
又は同法第三条第一項若しくは第四条の規定による貸付けを受けたもののうち、外国に渡航した
ときに公共の負担となるおそれがあるもの

7: 前各号に掲げる者を除くほか、外務大臣において、著しく、かつ、直接に日本国の利益又は公
安を害する行為を行うおそれがあると認めるに足りる相当の理由がある者
外務大臣は、前項第七号の認定をしようとするときは、あらかじめ法務大臣と
協議しなければならない。

たかがパスポート、されどパスポート。
忙しいを言い訳にせず写真は丁寧に撮影しましょう。
身だしなみを整え、相手に不安を与えない表情の写真を
使うことが最低限のマナーだと思います。
